Terms of Service

Evergreen Homeo (“we”, “us”, “our”) operates the Ever Green mobile app (the “App”), a patient–clinic communication service for the Evergreen Homeo homeopathy clinic. These Terms govern your use of the App and its features, including chat, voice calls, media sharing and educational health content (together, the “Service”). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance

By registering or using the Service you confirm you have read and accept these Terms and our Privacy Policy. If you use the Service for another person in your care, you confirm you are authorised to do so. These Terms apply to patients/clients; clinic staff may be subject to separate agreements.

2. The Service

Through the App you can exchange messages with clinic doctors and staff, share photos and documents, receive voice calls from the clinic, view the chamber location, read educational health information, and receive notifications. The Service facilitates communication; any clinical advice comes from the clinic’s practitioners, not from the App. We may add, change or remove features at any time.

3. Eligibility & age

You must be at least 18 years old to use the Service on your own behalf. If you are under 18, you may use it only through a parent or legal guardian who accepts these Terms. The Service is intended for users in Bangladesh.

You must not use the Service unlawfully or to harass, threaten, defame or impersonate anyone; upload illegal or infringing content; transmit malware or attempt unauthorised access; scrape other users’ data; send spam; or reverse-engineer the App except as permitted by law. We may remove content or suspend accounts that breach these Terms.

The App is a communication and scheduling tool. It is NOT a substitute for professional medical advice, diagnosis, treatment, or emergency care.

7. Fees

Any consultation fees are arranged with the clinic directly and paid in person at the chamber. Fee questions, refunds and cancellations are handled by the clinic case-by-case — contact support@evergreenhomeo.com.

8. Your content

You keep ownership of the content you submit (messages, images, voice notes, files). You grant us a limited licence to host, store, transmit and process that content solely to operate and provide the Service to you, and as described in our Privacy Policy. We may retain content to meet legal, audit and record-keeping obligations, as described there.

9. Intellectual property

The App and its software, design, content and trademarks (including the “Ever Green” name) are owned by or licensed to Evergreen Homeo. We grant you a limited, personal, non-transferable licence to use the App for your own non-commercial use of the Service. You may not copy, modify, distribute, sell or create derivative works from any part of the Service.

10. Third-party services

The Service relies on third-party providers for hosting, notifications, sign-in and voice calling. Your data may be processed by these providers and transferred across borders as described in our Privacy Policy. We are not responsible for the acts or omissions of third-party services.

11. Availability; no guarantee of delivery

We aim to keep the Service available but do not guarantee uninterrupted, error-free or secure operation. Messages, calls, notifications and reminders may be delayed or fail to deliver. You must not rely on the Service for time-critical or emergency communication (Section 6). Your content is accessible to the clinic and to us as needed to operate the Service.

12. Disclaimers & limitation of liability

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind. We make no warranty regarding any medical or health outcome or the accuracy of any guidance provided through the App. Evergreen Homeo and its owners, staff and providers shall not be liable for any indirect, incidental, special or consequential damages, or for any loss of data or health-related harm, arising from your use of (or inability to use) the Service, except to the extent such liability cannot be excluded under applicable law. Where we are found liable despite the above, our total aggregate liability shall not exceed BDT 5,000. Nothing here excludes liability that cannot lawfully be excluded.

13. Indemnity

You agree to indemnify and hold harmless Evergreen Homeo and its owners, staff and providers from claims, liabilities and expenses arising from your use or misuse of the Service, your content, or your violation of these Terms or any law or third-party right.

14. Suspension & termination

You may stop using the Service at any time and may delete your account from the App or by contacting us. As described in our Privacy Policy, certain health and account records may be retained after deletion for legal and audit purposes. We may suspend or terminate access if you breach these Terms or create risk or legal exposure for us or the clinic.

15. Governing law & disputes

These Terms are governed by the laws of the People’s Republic of Bangladesh. The courts of Dhaka, Bangladesh have exclusive jurisdiction over any dispute. Before formal proceedings, you agree to first try to resolve the dispute informally by contacting support@evergreenhomeo.com.

16. Changes

We may update these Terms. We will update the date above and provide notice through the App or by other reasonable means before material changes take effect. Continued use after they take effect means you accept the revised Terms.
